Disciplinary Committee Guidelines 1. All individuals who are under investigation for a disciplinary matter have the right to fair hearing. 2. All Cruisers Cricket Club members are eligible to report a breach of the Code of Conduct as documented in the club’s “Code of Conduct”. 3. All individuals who have been reported shall be given 3 days notice of the allegations against them and the procedure to be followed for determining the alleged breach(es) of the Code of Conduct. If a hearing is scheduled, the individual(s) shall be given 7 days notice to appear at the hearing and to answer the case against them. The time and location of the hearing must be properly notified to the reported person. Rescheduling of the hearing can only be done within 24 hours of the notice. 4. All individuals have the right to present their version of the facts and to bring witnesses, as they deem necessary. 5. Following receipt of occurrence of a breach of the Code, the Disciplinary Committee shall immediately investigate to the extent necessary in order to establish that the incident has been accurately and fully reported. Investigation at this point shall be restricted solely to the facts of the matter concerned and opinions shall not be solicited. 6. Committee discussion, investigation and deliberations may be conducted by any means of communication provided that the greatest reasonable care is exercised to ensure complete confidentiality so as to respect the rights to privacy of the individual(s) concerned. 7. The Committee shall not seek and shall not accept any testimony as to the accuracy or “fairness” of any Umpiring decision that may have given rise to the incident under investigation. Such testimony is considered irrelevant. 8. All individuals shall be held fully accountable for their own behavior. Claims of provocation or of prior violations by others shall not be accepted. 9. A harder line shall be taken when considering cases involving team Captains, Cruisers Executive committee and other senior players. Offences by the aforementioned shall be deemed greater by virtue of the nature of their position within the club. 10. Infractions, as defined in the Cruisers Code of Conduct, shall determine the penalty to be levied on the reported individual(s). Should an infraction that is not covered by the Code of Conduct be committed, the Disciplinary Committee reserves the right to determine the categorization of the infraction and proceed thereon. 11. Should an incident involve several members of the club or team, the Disciplinary Committee may apply the penalty to every member involved. 12. A period of suspension shall be specified as a number of matches, which could either be NCCA league matches or Social matches or a combination of both. 13. The Disciplinary Committee shall present its findings and notification of penalties imposed prior to the next scheduled match of the club, wherever possible. In any event, the findings must be presented no later than two weeks after receipt of the Breach of Conduct Report. 14. Findings and penalties shall be notified in writing directly to the reported players, Club Secretary, Team Captain and the individual(s) who reported the incident. A copy of the findings shall also be forwarded to the Cruisers members and Executive committee. 15. The Disciplinary Committee shall maintain a register of disciplinary actions. Any club officer may be provided with a list of currently suspended player(s) upon request. 16. The Team Captain or any individual member shall notify the Disciplinary Committee and Cruisers Executive Committee should any suspended player be found to have violated his suspension in any way. 17. Should a member of the committee be party to an incident or choose to disqualify himself from an enquiry for personal reasons, the President of Cruisers shall be notified and he may at his discretion appoint a temporary member to the committee. 18. The decisions of the Disciplinary Committee can be challenged with the Cruisers Executive committee. However, the concerned member must provide the Executive committee in writing sufficient reason for the challenge. If deemed necessary, the Executive committee will conduct its own enquiry and the decisions of the Executive Committee will be final and binding.
